Headlands Hotel Appeal – Land & Environment Court NSW

Expert witness acting for Wollongong Council

Lindsay Fletcher acted as an expert witness for Wollongong Council in a Class 1 appeal in the Land and Environment Court of NSW relating to redevelopment of the 7,000m2 Headlands Hotel site in Austinmer. The proposal related to subdivision of the land, demolition of the hotel, construction of bed and breakfast accommodation, serviced apartments and a day spa. Lindsay provided assistance to the Court on matters relating to characterisation of the use, visual impacts and consistency with state and local planning controls.

Surry Hills Microbrewery – Land & Environment Court NSW

Expert witness acting for City of Sydney Council

Jeff Mead acted as an expert witness for City of Sydney Council in a Class 1 appeal relating to a proposed restaurant and microbrewery within a mixed use zone of Surry Hills. The subject site is located in an area characterised by a mix of residential and commercial uses and the application attracted a large number of resident objections. Jeff provided assistance to the Court on matters relating to characterisation of the use, potential amenity impacts on surrounding properties and compliance with zoning objectives.

Reservoir Road, Blacktown – Land Acquisition Compensation Claim

Expert witness in Class 3 Land & Environment Court NSW Appeal

Lindsay Fletcher acted as an expert witness in a Class 3 appeal relating to a compensation claim following compulsory acquisition of a 5 hectare parcel containing Cumberland Plain Woodland by Blacktown Council. Joining several specialist expert witnesses, Lindsay provided assistance to the Court to establish an understanding of potential development yield for the site in light of significant environmental constraints including the land contamination and a threatened ecological community. This evidence assisted the Court in arriving at a compensation value.
